The obligation of an engine driver to keep a lookout in train traffic

A train driver does not have a duty to keep a lookout in train operations. However, in shunting operations, the driver is responsible in all situations for driving cautiously, controlling speed, and taking into account visibility in the direction of travel so that they are able to stop the unit before any obstacle.
Train operations also take place at relatively low speeds, as in this case. The earlier obstacles on the track are detected, the better the chances are to prevent an accident or significantly mitigate the resulting damage. In addition, it provides the driver with more time to take protective action if necessary.
Maintaining a lookout and using the ATP system are not mutually exclusive; together they help the driver make correct and timely decisions. The purpose of the driver’s duty to keep a lookout is not to change the current practice whereby a safe route is secured for the train, which is the responsibility of traffic control. The lookout duty also does not mean that the driver should be able to stop the train in all situations upon detecting an obstacle.

The Finnish Transport Safety Agency (Trafi) should order that engine drivers keep a lookout when in train traffic.
